Summary
Amends the: Crimes (Foreign Incursions and Recruitment) Act 1978, Criminal Code Act 1995 and Customs Act 1901 to extend the definition of terrorist organisation; Criminal Code Act 1995 and Financial Transaction Reports Act 1988 in relation to financing terrorism offences; Criminal Code Act 1995 to provide for control orders and preventative detention orders; Crimes Act 1914 to: extend stop, question, search and seize powers to all Commonwealth places and prescribed security zones; and provide for a notice to produce regime to ensure compliance with lawful requests for certain information; Crimes Act 1914, Criminal Code Act 1995, Migration Act 1958 and Surveillance Devices Act 2004 to update sedition offences; Aviation Transport Security Act 2004 to authorise the use of video surveillance at Australia’s major airports and on aircraft; Financial Transaction Reports Act 1988, Proceeds of Crime Act 2002 and Surveillance Devices Act 2004 in relation to financial transaction reporting; Australian Security Intelligence Organisation Act 1979 to: strengthen ASIO’s special powers warrant regime; provide ASIO with enhanced access to aircraft and vessel information; strengthen the offence for providing false or misleading information under an ASIO questioning warrant; and clarify that obligations, prohibitions or restrictions imposed by control orders will not be prescribed administrative action; Customs Act 1901 and Customs Administration Act 1985 to broaden Customs powers for security and intelligence purposes; and Migration Act 1958 to clarify the power to deport non-citizens on security grounds.
