Review of the Australian Security Intelligence Organisation Amendment Bill (No. 1) 2025

The Minister for Home Affairs and Minister for Cyber Security, the Hon Tony Burke MP, wrote to the Parliamentary Joint Committee on Intelligence and Security on 25 August 2025 to refer the Australian Security Intelligence Organisation Amendment Bill (No. 1) 2025 for inquiry and report.

The bill seeks to make only one change to the current Australian Security Intelligence Organisation Act 1979 (ASIO Act): extend the operation of the ASIO compulsory questioning warrant framework for a further 18 months. Item 1 of the bill would amend section 34JF of the ASIO Act to substitute the current sunset date of 7 September 2025 with a new date of 7 March 2027.

Given the limited effect of the bill and the short time available for the bill to pass before the scheduled sunset date, the Committee has agreed not to seek evidence and proceed to reporting to Parliament.

The Committee will undertake further investigation into the ASIO compulsory questioning framework in the concurrent Inquiry into Australian Security Intelligence Organisation Amendment Bill (No. 2) 2025.

About this inquiry

The Committee is reviewing the Australian Security Intelligence Organisation Amendment Bill (No. 1) 2025. Division 3 of Part III of the Australian Security Intelligence Organisation Act 1979 (ASIO Act) establishes ASIO’s compulsory questioning powers. The bill would extend the operation of the compulsory questioning warrant framework under the ASIO Act for a further 18 months.
