National Health Reform Amendment (Definitions) Bill 2013

Overview

1.1        This bill seeks to amend the National Health Reform Act 2011 to amend a number of definitions around hospitals to enable the National Health Performance Authority to undertake its performance reporting role and to make technical amendments.

Compatibility with human rights

1.2        The bill is accompanied by a self-contained statement of compatibility which states that the bill does not engage human rights and is therefore compatible with human rights.

1.3        The bill is intended to contribute to the improvement of the operation of the national health system. To this extent, the bill may be viewed as contributing to the promotion of the enjoyment of the right to the highest attainable standard of physical and mental health as guaranteed by article 12 of the International Covenant on Economic, Social and Cultural Rights. However, the bill does not appear to involve limitations on the enjoyment of that right.

1.4                  The committee considers that the bill does not appear to give rise to human rights concerns.
