This page contains information on the process for the Senate Community Affairs References Committee (the committee) to review legislative instruments regarding income management. Section 243B of the Social Security (Administration) Act 1999 (the Act) calls for such review of legislative instruments made under Part 3AA or Part 3B of the Act. In reviewing each relevant legislative instrument, the committee will consider the adequacy and appropriateness of the measures in the instrument, and the potential impact on people of the implementation of those measures.
Requirement for review by the Senate Community Affairs Reference Committee
Section 243B of the Social Security (Administration) Act 1999 (the Act) calls for the Senate Community Affairs References Committee to:
- Begin a review of each legislative instrument made under Part 3AA or Part 3B of the Act within 3 months of the tabling of the legislative instrument; and
- Report its findings to the Senate as soon as practicable after completing each review.
Part 3B of the Act concerns the 'Income Management Regime'. Part 3AA of the Act concerns the 'Enhanced Income Management Regime'.
Section 243B commenced in effect on 4 September 2023.
