C. Australian Federal Police activities
Terrorism Offences (Division 101)
1.1Over the review period, the Australian Federal Police (AFP) charged one individual with possessing things connected with acts under section 101.4 of the Criminal Code.
1.2One individual was charged with collecting or making documents likely to facilitate terrorist acts under section 101.5 of the Criminal Code.
1.3Two individuals were charged with other acts done in preparation for or planning terrorist acts under section 101.6 of the Criminal Code.
1.4Prosecutions for Division 101 terrorism offences commenced (but were not finalised) against three individuals during the period.
Terrorist Organisations (Division 102)
1.5Two individuals were charged under Division 102, with being a member of a terrorist organisation under section 102.3 of the Criminal Code. One person’s charge was withdrawn.
1.6Two prosecutions under Division 102 commenced (but were not finalised) during the period.
Financing Terrorism (Division 103)
1.7No charges were laid and no prosecutions were commenced or finalised under Division 103 of the Criminal Code.
Control Orders (Division 104)
1.8Between 1 July 2024 and 30 June 2025 no interim control orders were applied for by the AFP.
1.9No interim control orders were modified, no urgent interim control orders were requested and one control order was confirmed without variation.
1.10One person had an interim control order confirmed who had been convicted of a terrorism-related offence and reached the end of their sentence.
1.11No warrants were issued under Part IAAB of the Crimes Act 1914 in the period under review. Fourteen warrants were issued under subsection 46(4) of the Telecommunications (Interceptions and Access) Act 1979 for the purpose of monitoring compliance with control orders.
1.12No people were charged by the AFP for the offence of contravening a control order under section 104.27 of the Criminal Code. No prosecutions regarding contravention of a control order were commenced or finalised by the AFP during the period.
Preventative Detention Orders (Division 105)
1.13The AFP did not apply for and was not issued with any preventative detention orders between 1 July 2024 and 30 June 2025.
1.14No preventative detention orders were revoked under section 105.17 and no prohibited contact orders were applied for, issued or revoked over the reporting period.
1.15No persons were taken into custody under a preventative detention order and no persons were charged by the AFP or with the AFP’s support for disclosure offences for preventative detention orders. No prosecutions were commenced or finalised.
Post-sentence terrorism orders (Division 105A)
1.16The AFP Minister did not apply for any continuing detention orders (CDO) or interim detention orders in the reporting period.
1.17No person was taken into custody under a CDO by the AFP in the review period.
1.18During the period one extended supervision order was issued on the application of the AFP Minister. In addition, the Minister applied for four interim supervision orders, all of which were issued and in force for 28 days each. Three people were in the community under post-sentence supervision orders during the period.
Stop, Search and Seizure Powers (Division 3A, Part 1AA)
1.19In the review period, the AFP did not stop, detain, or search any persons, property or vehicles for terrorism related items under section 3UD of the Criminal Code. The AFP did not seize any terrorism related items or seek emergency entry to premises.
1.20The AFP did not secure any premises pending the issue of a warrant and no zones were declared by the Minister to be ‘prescribed security zones’ under section 3UJ.
