Maritime Transport and Offshore Facilities Security Amendment Regulation 2012 (No. 3)

FRLI ID: F2012L02263
Portfolio: Infrastructure and Transport

Committee view

2.2        The committee seeks clarification from the Minister for Infrastructure and Transport in relation to the possible impact this regulation may have on the right to privacy, and any safeguards that may be in place to ensure that any interference is justifiable.

Overview

2.3        This regulation amends the Maritime Transport and Offshore Facilities Security Regulations 2003 to, among other things, prescribe continual supervision by security personnel and/or continual monitoring by Closed Circuit Television (CCTV) as the supervision and control measures for ensuring that persons and baggage that have received clearance remain cleared on vessels that are not cleared vessels or in areas that are not cleared areas.

Compatibility with human rights

2.4        The statement of compatibility states that the regulation does not engage any of the applicable rights or freedoms.

2.5        However, by prescribing continuous supervision by security personnel and/or continuous monitoring by CCTV the regulation may engage the right to privacy in article 17 of the International Covenant on Civil and Political Rights (ICCPR).
