Regulations and other Disallowable Instruments

Subsection 48(4) of the Acts Interpretation Act 1901 deals with notices of motion to disallow Regulations and other legislative instruments. In particular, subsection 48(4) provides that if either House of the Parliament, in pursuance of a motion of which notice has been given within 15 sitting days after any regulations or other disallowable instruments have been laid before that House, passes a resolution disallowing any of those legislative instruments, any legislative instrument so disallowed thereupon ceases to have effect.

Any Senator or Member of the House of Representatives is entitled to give a notice of motion to disallow. The Chair of the Senate Standing Committee on Regulations and Ordinances gives notices of motion on behalf of the Committee relating to the its scrutiny of instruments. This disallowance alert provides information on

  • disallowance action initiated by the Regulations and Ordinances Committee
  • disallowance action initiated by individual Senators
  • disallowance action initiated by individual Members of the House of Representatives.

Unresolved notices of motion to disallow when Parliament was prorogued for 2001 federal election

There were three unresolved notices of motion to disallow instruments in the Senate when the Parliament was prorogued for the 2001 federal election. These notices related to:

  • Air Navigation (Essendon Airport) Regulations 2001, Statutory Rules 2001 No.125
  • Quarantine Service Fees Determination 2001 (No.1 of 2001) made under section 86E of the Quarantine Act 1908
  • Veterans' Entitlements (Means Test Treatment of Private Companies - Excluded Companies) Declaration 2001 made under subsection 52ZZA(5) of the Veterans' Entitlements Act 1986

The notices on these instruments lapse at the end of the old Parliament but in accordance with subsection 48(5A) of the Acts Interpretation Act 1901, these instruments will be deemed to have been tabled on the first sitting day of the Senate in the new Parliament. In effect, these instruments will be treated as if they had been tabled for the first time and any Senator will have 15 sitting days in which to give a notice of motion to disallow any of them.

Motion brought on for debate on 27/3/2001 but the Senate did not agree to disallow Item 3 of Schedule 3 of the Regulations.
