of Revocation - May 2013
FRLI: F2013L00889
Portfolio: Immigration and
Citizenship Summary of committee view
2.1
The committee
seeks further information in order to enable it to better understand the effect
and operation of these instruments. Overview
2.2
The Migration
Regulations 1994 - Revocation under paragraph 5.36(1A)(a) - Instrument of
Revocation - May 2013 revokes the current legislative instrument (IMMI
12/134) which specifies the Iranian Rial as a foreign currency for the purposes
of paragraph 5.36(1A)(a) of the Migration Regulations 1994.
2.3
The Migration
Regulations 1994 - Revocation under paragraph 5.36(1)(a) and 5.36(1)(b) -
Instrument of Revocation - May 2013 revokes the existing instrument (IMMI
12/135) which specifies Iran as a place in which payment of a fee must be made
and which specifies the Iranian Rial as a currency in which a fee may be paid
in that place. The purpose of the instrument is to remove Iran as a specified
place and to remove the Iranian Rial as a relevant currency for use when paying
a visa application charge when applying in Iran for a visa to enter Australia. Compatibility with human
rights
2.4
The committee
notes that these instruments are exempt from the requirement to provide a
statement of compatibility; however the committee requires further information
in order to enable it to better understand the effect and operation of these
instruments.
2.5
The
committee intends to write to the Minister for Immigration and Citizenship to
seek further information in relation to:
- the impact of
these instruments on the ability of individuals in Iran to lodge visa
applications (including the process by which individuals in Iran will now need
to follow in order to lodge a valid visa application);
- a list of the
other countries where the above process applies; and
- the rationale
for revoking instruments IMMI 12/134 and IMMI 12/135.
