  Amends the:

  Crimes Act 1914

  to: facilitate the use of video link evidence from overseas witnesses in proceedings for terrorism and other related offences and proceeds of crime proceedings relating to those offences; clarify a constitutional issue regarding the conferral of non-judicial functions and powers on Judges of the Federal Court and Federal Magistrates; facilitate inter-jurisdictional matching of DNA profiles through a national database; and expand the definition of “tape recording”;

  Financial Transaction Reports Act 1988

  to rectify an unintended omission;

  Foreign Evidence Act 1994

  to facilitate the use of foreign material, such as video tapes and transcripts of examinations, as evidence in terrorism and related proceedings when video link evidence is not possible; and provide a discretion to prevent foreign material being adduced;

  Proceeds of Crime Act 2002

  to: enable payments out of the Confiscated Assets Account to third parties who carry out examinations for the Commonwealth; and rectify the unintended consequence of a regulation change that inadvertently affected the legal status of some examiners; and

  Surveillance Devices Act 2004

  to enable the issue of a warrant to retrieve a tracking device installed under an authorisation.

  Amends the:

  Australian Federal Police Act 1979

  to: provide for a new complaints and professional standards regime within the Australian Federal Police (AFP) which will categorise all matters raised in relation to AFP professional standards according to their nature and seriousness; provide for alcohol screening tests of on duty officers; and to make amendments relating to suspension or resignation from, and termination of, employment; and

  Ombudsman Act 1976

  to align the Ombudsman’s administrative review role over the AFP more closely with the role it has in relation to other Australian Government agencies, although the Ombudsman will retain the capacity to intervene in serious cases and will have a review role in relation to the new complaints and professional standards regime. Also repeals the

  Complaints (Australian Federal Police) Act 1981

  and makes consequential amendments to the

  Australian Federal Police Act 1979

  and 7 other Acts.

  Introduced with the Law Enforcement Integrity Commissioner Bill 2006, the bill makes amendments consequential on the establishment of the Office of the Integrity Commissioner and the Australian Commission for Law Enforcement Integrity (ACLEI) to 17 Acts to: provide ACLEI investigators with access to special investigative powers, including the capacity to use telecommunications interception, surveillance devices, controlled deliveries and assumed identities; and provide the Integrity Commissioner and the ACLEI with access to certain confidential information; and amends the

  Criminal Code Act 1995

  to insert new offences in relation to trafficking in, manufacturing, possessing, importing and exporting unmarked plastic explosives;

  Customs Act 1901

  to provide Customs officers with appropriate powers to regulate, investigate, search and seize unmarked plastic explosives; and six other Acts to make consequential amendments.
