    Introduced with the National Vocational Education and Training Regulator Amendment (Annual Registration Charge) Bill 2017, the bill amends the
    National Vocational Education and Training Regulator (Charges) Act 2012
    to: impose a National VET regulator (NVR) annual registration charge as a tax; and validate annual registration fees collected by the Australian Skills and Quality Authority from NVR registered training organisations and certain providers registered on the Commonwealth Register of Institutions and Courses for Overseas Students before 1 July 2017.

    Amends the
    National Vocational Education and Training Regulator Act 2011
    to: insert or clarify definitions for ministerial council, registered training organisation, registration code, quality standards and vocational education and training (VET) information; extend the operation of penalty provisions to trading corporations; prohibit a person from advertising or offering VET courses without including the name and registration code of the responsible registered training organisation; extend to 7 years the period of registration able to be granted by the National VET Regulator (NVR); provide that the minister may make quality standards; provide that it is a condition of registration that an NVR registered training organisation must satisfy the quality standards; specify to whom, and for what purpose, the regulator may disclose VET information; streamline the processes required for the issuing of a written direction by the regulator; and clarify that a person employed in a court of a state or territory may issue a search warrant if authorised to do so.

    In response to issues raised by the Senate Standing Committee for the Scrutiny of Bills and recommendations made by the Senate Education, Employment and Workplace Relations Legislation Committee, the bill amends the
    National Vocational Education and Training Regulator Act 2011
    to: add an objects clause; clarify which laws of the states and territories apply to registered training organisations; clarify the circumstances when the Regulator can amend an accredited course without an application being made by the course owner; ensure that a person is aware of the cancellation of the qualification or statement of attainment before being liable for a civil penalty; limit the use of force; require authorised officers to possess certain experience, training and qualifications; enable information sharing with the Tertiary Education Quality Standards Agency; and make technical amendments.
