  Implements the second tranche of changes to Australia's critical infrastructure framework by amending the:

  Security of Critical Infrastructure Act 2018

  to: provide that specified critical infrastructure assets must adopt and maintain a critical infrastructure risk management program; provide for annual reporting obligations for assets that are exempt from the risk management program obligation; make minor amendments in relation to consultation requirements and immunities; provide for additional cyber security obligations that may be applied in relation to systems of national significance; provide that directions facilitating government assistance to industry in the event of a serious cyber security incident prevail over the requirements of a risk management program; amend provisions that authorise the use and disclosure of protected information; provide that the minister's power to privately declare an asset as a critical infrastructure asset includes a power to require compliance with a risk management program; enable the minister to declare a critical infrastructure asset to be a system of national of significance; and include additional reporting requirements; and

  AusCheck Act 2007

  to make consequential amendments. Also makes a technical amendment to the

  Criminal Code Act 1995

  Security of Critical Infrastructure Act 2018

  to: enhance the existing framework for managing risks relating to critical infrastructure by introducing: additional positive security obligations for critical infrastructure assets, including a risk management program, to be delivered through sector-specific requirements and mandatory cyber incident reporting; enhanced cyber security obligations for assets of national significance; government assistance to relevant entities for critical infrastructure sector assets in response to significant cyber attacks; and make amendments contingent on the commencement of the

  Federal Circuit and Family Court of Australia Act 2020

  ;

  Administrative Decisions (Judicial Review) Act 1977

  to exclude certain decisions from judicial review; AusCheck Act 2007 to enable background checks should they be required as part of a critical infrastructure risk management program;

  National Emergency Declaration Act 2020

  Security of Critical Infrastructure Act 2018

  to make amendments contingent on the commencement of the

  National Emergency Declaration Act 2020

  Part of a package of four bills, the bill amends the:

  Criminal Code Act 1995

  to: insert new offences in relation to treason and terrorism related activities, all of which carry a penalty of life imprisonment; provide for ministerial declaration of proscribed organisations and insert offences in relation to membership or links with such an organisation;

  Crimes Act 1914

  to repeal the existing treason offence;

  Migration Act 1958

  to update treason offence cross-references; and

  Australian Protective Service Act 1987

  and

  Crimes (Aviation) Act 1991

  to ensure that the Australian Protective Service has power to deal with terrorist related offences and to perform the aircraft security officer function on intra-state flights. Also contains savings and application provisions.

  Introduced with the Cyber Security Bill 2024 and Intelligence Services and Other Legislation Amendment (Cyber Security) Bill 2024 to implement certain measures proposed by the 2023-2030 Australian Cyber Security Strategy, the bill amends the:

  Security of Critical Infrastructure Act 2018

  to: clarify obligations in relation to certain data storage systems that store or process business critical data; expand the government assistance framework to facilitate the management of consequences of impacts of incidents on critical infrastructure assets; amend the definition of ‘protected information’ to include a harms-based assessment and non-exhaustive list of relevant information; clarify the use and disclosure of protected information; enable the regulator to direct an entity to remedy a seriously deficient risk management program; consolidate security requirements for critical telecommunications assets; remove direct interest holders from reporting obligations associated with Systems of National Significance.   Introduced with the Security of Critical Infrastructure (Consequential and Transitional Provisions) Bill 2017, the bill provides for the management of the national security risks of espionage, sabotage and coercion arising from foreign involvement in Australia’s critical infrastructure by: establishing a Register of Critical Infrastructure Assets; providing the minister with a power to direct a reporting entity or operator of a critical infrastructure asset to do, or refrain from doing, an act or thing within a specified period of time; empowering the secretary to request certain information from reporting entities and operators of critical infrastructure assets; and providing that the minister can privately declare an asset to be a critical infrastructure asset in certain circumstances.
