The Bill amends the ACIS
Administration Amendment Act 2009 (the Act) to correct an
unintended consequence arising from the Act s link to the
commencement of the Automotive Transformation Scheme Act
2009.
The Government s policy arrangements for the automotive industry
were announced in
A New Car Plan for a Greener Future. The two pieces of
legislation implementing the policy arrangements, the ACIS
Administration Amendment Bill 2009 and the Automotive
Transformation Scheme Bill 2009, were enacted on 29 September
2009.
To assist with the transition from the Automotive
Competitiveness and Investment Scheme to the Automotive
Transformation Scheme additional assistance will be provided to
motor vehicle producers in 2010 under the Act. The additional
assistance which is estimated at $79.6 million arises from changes
to the formula for calculating unmodulated production
credits.[1]
The Bill clarifies that the commencement of the Act is 1 January
2010 as intended and that additional assistance to motor vehicle
producers will apply from that date. It removes any doubt that the
new provisions for calculating unmodulated production credits could
be applied to the production of motor vehicles, engines and engine
components in the final three months of 2009.

ACIS Administration Amendment Act 2009
Item 1 replaces the commencement date in the
Act to make it explicit that the amendments to the Automotive
Competitiveness and Investment Scheme commence on
1 January 2010.
Item 2 provides that items 12-16 of the Act
apply to working out unmodulated production credits for a quarter
beginning on or after 1 January 2010.
