  Amends the

  Transport Safety Investigation Act 2003

  to: provide state and territory government ministers, who have a responsibility for rail transport, with a power to request the Australian Transport Safety Bureau (ATSB) to conduct certain investigations in their jurisdiction; clarify the ATSB’s capacity to conduct investigations within, or to or from, a Commonwealth territory; and provide that certain information obtained or generated by the ATSB may be disclosed under certain circumstances.

  Introduced with the Civil Aviation Amendment Bill 2009, the bill amends the

  Transport Safety Investigation Act 2003

  to: establish the Australian Transport Safety Bureau as a statutory agency from 1 July 2009; and allow for regulations to be made to establish voluntary and confidential reporting schemes. Also makes consequential amendments to four other Acts and provides for transitional arrangements.

  Consequential on the Transport Safety Investigation Bill 2002, the bill: repeals certain provisions of the

  Air Navigation Act 1920

  and

  Navigation Act 1912

  concerning aviation and marine safety investigations; and amends the:

  Air Services Act 1995

  Civil Aviation Act 1988

  and

  Australian Maritime Safety Authority Act 1990

  to include cooperation with the Australian Transport Safety Board in the objects of the Acts;

  Civil Aviation Act 1988

  to protect the confidentiality of cockpit voice recording information; and
