    Implements Australia’s obligations in relation to sulphur emissions from ships under Annex VI of the International Convention for the Prevention of Pollution from Ships by amending the
    Protection of the Sea (Prevention of Pollution from Ships) Act 1983
    to: enable ships to use non-compliant fuel from 1 January 2020 if they are fitted with a scrubber or other equivalent compliance methods to reduce sulphur from their emissions to below the prescribed limit; prohibit the carriage of high sulphur fuel for propulsion purposes on board a ship from 1 March 2020 (carriage ban); exempt naval and foreign government vessels from the application of the Act; and clarify obligations of fuel oil suppliers to verify fuel quality.

    Amends the
    Protection of the Sea (Powers of Intervention) Act 1981
    which gives effect to Australia’s obligations under the International Convention Relating to Intervention on the High Seas in Cases of Oil Pollution Casualties, 1969 by enabling the Australian Maritime Safety Authority to intervene in the event of any threat of pollution from a ship in Australian waters or on the high seas. The bill gives effect to national maritime emergency response arrangements agreed between the Commonwealth, State and Northern Territory governments, enabling the Commonwealth to undertake the role of national coordinator and decision-maker in responding to an actual or potential pollution incident. Also makes a technical amendment to the
    Legislative Instruments Act 2003
    to repeal a section redundant as a consequence of the amendments to the
    Protection of the Sea (Powers of Intervention) Act 1981

    Introduced with the Protection of the Sea (Civil Liability for Bunker Oil Pollution Damage) (Consequential Amendments) Bill 2008, the bill implements the International Convention on Civil Liability for Bunker Oil Pollution Damage which establishes a liability and compensation regime to apply in cases of pollution damage following the leakage of bunker oil from a ship that is not an oil tanker.
