Summary

Amends the Defence Force Discipline Act 1982 to: restructure the military discipline system; and reflect the general principles of criminal responsibility in the Criminal Code Act 1995 in existing offence provisions; Defence Act 1903 to: increase the penalties for persons falsely representing themselves to be returned service personnel or for improperly using medals or decorations; and clarify the regulation-making powers in relation to defence inquiries; Defence Force (Home Loans Assistance) Act 1990 to permit certain ex-members of the Australian Defence Force to apply for a home loan subsidy beyond the current 2-year eligibility period; Defence Legislation Amendment (Application of Criminal Code) Act 2001 to clarify that its commencement date is 15 December 2001; Defence Reserve Service (Protection) Act 2001 to correct a cross-reference; and 6 Acts to modernise the titles of the Cadet Corps. Also amends the Defence Legislation Amendment (Application of Criminal Code) Regulations 2001 (No. 1) and Defence Legislation Amendment (Application of Criminal Code) Regulations 2001 (No. 2) to clarify that their commencement date is 15 December 2001.
