  Amends the

  National Health Act 1953

  to: extend the operation of pharmacy location rules and their administration by the Australian Community Pharmacy Authority (ACPA) to 30 June 2010; increase the membership of the ACPA to include a consumer representative; provide for a Ministerial discretionary power in relation to approval of a pharmacist; clarify the Secretary’s ability to approve more than one pharmacist to supply pharmaceutical benefits in respect of particular premises and the Minister’s power to determine conditions relating to premises applying to approval to supply pharmaceutical benefits; simplify the approval process for pharmacists wishing to expand or contract their premises; and make minor technical amendments.

  to: include a new definition of “special assistance school” to ensure maximum general recurrent funding to non-government schools that cater primarily for students with social, emotion of behavioural difficulties who are at risk of leaving mainstream schooling; vary the grant years of certain capital infrastructure grant funding; include a regulation-making power to allow programme funding to be varied to another programme year without needing to amend the Act; move unspent Tutorial Voucher Initiative funding for 2004 under the

  States Grants (Primary and Secondary Education Assistance) Act 2000

  to the 2006 year of the National Projects element of the Literacy, Numeracy and Special Learning Needs Programme under the Act; and correct a cross reference.

  to: allow deductions for certain business capital expenses and certain lease and licence-related payments; and amend the cost base for capital gains tax assets and cost rules for uniform capital allowances assets;

  to: introduce a civil penalty regime to deter the promotion of tax avoidance and tax evasion schemes and the implementation of schemes in a materially different way to the relevant taxation product ruling; and provide for injunctions to stop promotion of schemes and enforcement of voluntary undertakings; and

  Amends the

  Telecommunications (Interception) Act 1979

  to: establish a warrant regime for enforcement agencies to access stored communications held by a telecommunications carrier; and amend the long and short titles of the Act to reflect this access; and makes consequential amendments to 9 other Acts to reflect the Act’s changed title. Also amends the

  Telecommunications (Interception) Act 1979

  to: enable interception of communications of a person known to communicate with a person of interest; permit equipment-based interception; remove the distinction between class 1 and class 2 offences; remove the Telecommunications Interception Remote Authority Connection function currently exercised by the Australian Federal Police and transfer the associated warrant register function to the Attorney-General’s Department; and make other amendments in relation to the ongoing operation of the interception regime.
