DELEGATED LEGISLATION MONITOR

This week there were 108 disallowable instruments of delegated legislation tabled in the Senate, made under 36 separate enabling Acts administered through 14 Departments of State.

Of the 108 instruments, 20 are from the Statutory Rules series of delegated legislation, which are generally superior in drafting, presentation and access to other forms of delegated legislation. This proportion of Statutory Rules in the total number is usual, illustrating the long term trend towards the greater use of instruments in series other than the Statutory Rules. Of the 108 instruments, 35 were made by the Governor-General or Ministers and 73 were made by public officials. Of the 20 sets of Statutory Rules, three were made as principal instruments and 17 as amending instruments.

The Remuneration Tribunal Determination No.1 of 1998 determines entitlements for Senators and for Members of the House of Representatives, including electorate allowance, travel entitlements – scheduled commercial transport, car transport, private vehicle allowance, provision of vehicle, charter aircraft/drive yourself vehicles, life gold pass, severance travel, overseas travel and office facilities. The Remuneration Tribunal Determination No.2 of 1998 amends the conditions of payment of travelling allowance for Members of Parliament and for Ministers. The Remuneration Tribunal Determination No.3 of 1998 provides for the reimbursement of expenses reasonably incurred by Parliamentary Secretaries.

The Determination of Slot Management Scheme 1998 provides details for the administration of the maximum aircraft movement limit at Sydney (Kingsford-Smith) Airport, set at 80 movements per hour, by allocating permissions to take-off and land.

The Broadcasting Services (Events) Notice No.1 of 1994 (Amendment No.1 of 1997) provides for certain rugby league matches, whether described as rugby league, super league, or some other name, to be events of a kind the televising of which should be available free to the public.

This week there were a number of instruments tabled which were made under the Aged Care Act 1977. The User Rights Principles Amendments (Nos 6 and 7) 1997 both provide for the administration of accommodation bonds for care recipients. The Residential Care Subsidy Amendment Principles (No.1) 1998 implements the change from accommodation bonds to accommodation charges. The Allocation Principles Amendment (No.1) 1997, the Approved Provider Principles Amendment (No.1) 1997 and the Allocation Principles Amendment (No.1) 1997 all implement undertakings given to the Standing Committee on Regulations and Ordinances.

The Health Insurance Regulations (Amendment), Statutory Rules 1998 No.44, implement aspects of provisions in the enabling Act which preclude Medicare benefits being paid to a patient in respect of a service rendered by a medical practitioner who completed his or her internship after 1 November 1996, unless certain conditions are met.

The Migration Agents Registration Application Charge Regulations 1998 and the Migration Agents Registration Renewal Charge Regulations 1998, Statutory Rules 1998 Nos 34 and 35, provide for charges payable in relation to registration as a Migration Agent.
