DELEGATED LEGISLATION MONITOR

This week there were 386 disallowable instruments of delegated legislation tabled in the Senate, made under 82 separate enabling Acts administered through 16 Departments of State. This number is usual, due to this week being the first week in a two week sitting period following a recess.

Of the 386 instruments, 102 are from the Statutory Rules series of delegated legislation, which are generally superior in drafting, presentation and access to other forms of delegated legislation. This proportion of Statutory Rules in the total number is usual, illustrating the long term trend towards the greater use of instruments in series other than the Statutory Rules. Of the 386 instruments, 137 were made by the Governor-General or Ministers and 249 were made by public officials. Of the 102 sets of Statutory Rules, 19 were made as principal instruments and 83 as amending instruments.

The Explanatory Statement for the Migration Regulations (Amendment), Statutory Rules 1997 No.354, advises that they are intended, among other things, to curtail abuse of the domestic violence provisions.

The Petroleum Retail Marketing Sites Regulations (Amendment), Statutory Rules 1997 No.355, are unusual in that they amend a set of amending regulations rather than the Principal Regulations. The Regulations also operate retrospectively and would, by virtue of subsection 48(2) of the Acts Interpretation Act 1901, be of no effect if they affect adversely the rights of a person other than the Commonwealth. The Explanatory Statement for the Regulations advises that it is unlikely that its provisions breach s.48(2). However, to avoid doubt the Regulations include a saving provision which preserves any rights which may have existed at the retrospective date of effect.

The Income Tax Regulations (Amendment), Statutory Rules 1997 No.338, are unusual in that they commence not on a particular date, but are expressed to commence at 7.30 pm, by legal time in the Australian Capital Territory, on 20 August 1996. The retrospective commencement was authorised by an amendment of the enabling Act which overrode s.48(2) of the Acts Interpretation Act.

The National Health Act Regulations (Amendment), Statutory Rules 1997 No.353, provide for a project intended to address two of the major concerns facing patients with private health insurance, being out-of-pocket medical costs and multiple bills. Under express authority of the enabling Act the Regulations modify the Act itself. The Regulations also include a "sunset" period of operation of 12 months or before then if the modified provisions of the Act are amended in any way.

The Explanatory Statement for the Public Service Regulations (Amendment - Interim Reforms), Statutory Rules 1998 No.23, advises that they provide for a wide range of matters, including a set of APS Values, a new Code of Conduct and protection for "whistleblowers" from victimisation and discrimination. The Regulations do not apply to Parliamentary Departments.

The Defence Determination 1997/43 provides, among other things, for a Pet Relocation Expenses Allowance.
