Inquiry into the operation of the Law Enforcement Integrity Commissioner Act 2006

Information about the Inquiry

On 14 May 2009, the Parliamentary Joint Committee on the Australian Commission for Law Enforcement Integrity initiated an inquiry into the operation of the Law Enforcement Integrity Commissioner Act 2006. Terms of Reference for the inquiry are below.

Pursuant to the committee's duties set out in subsection 215(1)(d) of the Law Enforcement Integrity Commissioner Act 2006 and with reference to section 223A of the LEIC Act, which provides for the review of the first three years of the operation of the Act, the committee will inquire into the operation of the Law Enforcement Integrity Commissioner Act 2006 (LEIC) and its regulations.

In particular, the committee will inquire into the following matters:

  1. Provisions for the extension of ACLEI's jurisdiction including but not limited to:

    1. The merits or limits of extending ACLEI's jurisdiction to other Commonwealth departments and agencies with a law enforcement function and/or coercive powers;

    2. an examination of the definition of 'law enforcement function' within the Act (section 5), including identification of the agencies to whom this definition applies;

    3. the administrative and operational practicalities of restricting the Integrity Commissioner's jurisdiction to matters pertaining to an agency's law enforcement function;

    4. the merits or limits of extending jurisdiction to other agencies by means of regulation or legislation; and

    5. the expansion of the Integrity Commissioner's anti-corruption education and prevention role to all Commonwealth departments and agencies.

  2. administrative, policy, legislative and case law developments that may affect ACLEI's practices and/or legislation;

  3. the adequacy of ACLEI's reporting requirements with respect to performance and to investigation outcomes as set out in the Act and associated regulations;

  4. the strengths and the limits of the LEIC Act and regulations, and of other arrangements arising from the Law Enforcement Commissioner (Consequential Amendments) Act 2006;

  5. the resources required to perform the functions set out in the LEIC Act and, in particular, the resourcing implications of any extension of ACLEI's jurisdiction.

The Committee invites submissions to the inquiry, addressing some or all of the terms of reference. The deadline for receipt of submissions is 26 June 2009, however extensions of time may be negotiated with the Secretariat prior to the deadline.

The Committee prefers submissions to be sent electronically, and postal and email addresses are specified below. Submissions can also be made through the new Senate Committee Online Submission System which can be accessed at https://senate.aph.gov.au/submissions. Submitters are requested to ensure that all personal details, including names and addresses are contained within a document separate from the submission (such as a covering letter).

All submissions become Committee documents upon receipt and may be published, including on the internet. Persons lodging submissions, however, must not make them public without the prior written approval of the Committee.
