  Provides financial assistance to the States and Territories for government and non-government schools for 2005-2008 by providing for: integration of Catholic system schools in the socioeconomic status (SES) funding model for non-government schools; a funding guarantee to independent non-government schools that would otherwise be disadvantaged from updating the SES scores for 2005-2008; additional funding for the Capital Grants Program for constructions and refurbishments in non-government schools in isolated locations in the Northern Territory; establishment of the Literacy, Numeracy and Special Learning Needs Program for disadvantaged students; additional funding for capital infrastructure for schools; funding for non-government rural student hostels; and extension of the national testing and Statements of Learning to include information and communications technology.   Summary

  Introduced with the Education Legislation Amendment Bill 2008, the bill provides financial assistance to the states and territories for non-government schools for 2009-2012 to: maintain the current socioeconomic status funding and indexation arrangements to ensure that total recurrent funding for schools will not fall below 2008 levels; provide recurrent funding for Indigenous Supplementary Assistance and an Indigenous Funding Guarantee; provide a remoteness loading; provide funding for capital grants; provide for establishment assistance grants in 2009; implement a school performance information and reporting framework; and require authorities and schools to implement the National Curriculum before the 2012 school year commences.

  to: insert new offences in relation to treason and terrorism related activities, all of which carry a penalty of life imprisonment; provide for ministerial declaration of proscribed organisations and insert offences in relation to membership or links with such an organisation;

  to repeal the existing treason offence;

  Migration Act 1958

  to update treason offence cross-references; and

  Australian Protective Service Act 1987

  and

  Crimes (Aviation) Act 1991

  to ensure that the Australian Protective Service has power to deal with terrorist related offences and to perform the aircraft security officer function on intra-state flights. Also contains savings and application provisions.
