Agriculture, Fisheries and Forestry Legislation Amendment Bill (No. 1) 2002

Amends the Quarantine Act 1908 to: extend the application of the Act to Christmas Island; improve arrangements for the payment of fees; broaden the range of persons who may be appointed as quarantine officers; and make clarifying amendments; Imported Food Control Act 1992 to: insert an objective into the Act; provide for the use of compliance agreements; and allow for the importation of food that does not meet applicable labelling standards, but create an offence if that food is sold by the importer without corrected labelling; and Pig Industry Act 2001 and Wool Services Privatisation Act 2000 to allow Australian Pork Limited and Australian Wool Innovation Limited to carry forward research and development expenditure eligible for Commonwealth matching contributions from one financial year to the next.

Makes technical amendments to the Australian Wine and Brandy Corporation Act 1980, Export Control Act 1982, National Residue Survey Administration Act 1992, Quarantine Act 1908 and Dairy Industry Legislation Amendment Act 2002. Australian Animal Health Council (Live-stock Industries) Funding Amendment Bill 2002

Amends the Australian Animal Health Council (Live-stock Industries) Funding Act 1996 to enable monies received through Emergency Animal Disease Response levies and charges in the event of an emergency animal disease response to be appropriated out of the Consolidated Revenue Fund and paid to the Australian Animal Health Council to allow it to repay livestock industries—€™ liability to the Commonwealth in relation to the Emergency Animal Disease Response Agreement; and provide a mechanism for any excess levies and charges to be appropriated for research and development activities for the promotion or maintenance of the health of animals.

Australian Capital Territory Legislation Amendment Bill 2002

Amends the: Australian Capital Territory (Self-Government) Act 1988 to: align the Act with the Electoral Act 1992 (ACT); and make technical amendments, including the removal of redundant references; and Australian Capital Territory (Planning and Land Management) Act 1988 to remove the requirement for the full-time member of the National Capital Authority to be present at meetings for there to be a quorum when the full-time member has disclosed a pecuniary interest.

Australian Citizenship Legislation Amendment Bill 2002

Amends the Australian Citizenship Act 1948 to: update aspects of Australian citizenship law and, in particular, enhance provisions relating to citizenship of children and young adults; enable adult Australian citizens to retain their citizenship when they acquire another citizenship; and strengthen existing integrity measures, including —€˜people smuggling—€™ provisions. Australian Crime Commission Establishment Bill 2002

Establishes the Australian Crime Commission (ACC) which will combine the functions of the National Crime Authority (NCA), the Australian Bureau of Criminal Intelligence and the Office of Strategic Crime Assessments. The bill: amends the National Crime Authority Act 1984 (which will be renamed to the Australian Crime Commission Act 2002) to: replace the NCA with the ACC and establish the governing and administrative regimes for the new body, including provision for its review after 1 January 2006; makes consequential amendments to 21 other Acts; and makes amendments to the renamed Australian Crime Commission Act 2002, Proceeds of Crime (Consequential Amendments and Transitional Provisions) Act 2002 and Telecommunications (Interception) Act 1979 contingent on the commencement of other Acts. Also contains transitional provisions.

Australian Heritage Council Bill 2002

Introduced with the Australian Heritage Council (Consequential and Transitional Provisions) Bill 2002 and in conjunction with the Environment and Heritage Legislation Amendment Bill (No. 1) 2002, the bill: replaces the Australian Heritage Commission by establishing the Australian Heritage Council which will provide advice on the identification, conservation and protection of places on the National Heritage List and the Commonwealth Heritage List; and provides for the functions, composition and conduct of meetings of the Australian Heritage Council. Also includes a regulation-making power.

Australian Protective Service Amendment Bill 2002

Australian Security Intelligence Organisation Legislation Amendment (Terrorism) Bill 2002

Amends the: Australian Security Intelligence Organisation Act 1979 to strengthen its counter-terrorism powers, in particular by: enabling the Australian Security Intelligence Organisation (ASIO) to seek a warrant to detain and question persons over 14 years of age for the purposes of investigating terrorism offences; and provides for safeguards in relation to these new powers, and penalties for officials—€™ failure to comply with provisions; and Telecommunications (Interception) Act 1979 in relation to the authorisation of communication of intelligence by persons other than ASIO officers. Also provides for review of the operation of the legislation 3 years after its commencement.

Aviation Legislation Amendment Bill 2002

Amends the: International Air Services Commission Act 1992 to streamline International Air Services Commission processes; Air Navigation Act 1920 (in preparation for new aviation security regulations) to: introduce a framework for handling aviation security information (including application of the Criminal Code); reform the regulation of the carriage of munitions and implements of war on civil aircraft; and repeal existing conflicting aviation security provisions. Also repeals the Federal Airports Corporation Act 1986 and provides for the transfer of any remaining contracts, assets and liabilities of the Corporation to the Commonwealth.

Amends the: Protection of the Sea (Civil Liability) Act 1981 and Protection of the Sea (Oil Pollution Compensation Fund) Act 1993 to increase the monetary liability and compensation for pollution damage resulting from the escape or discharge of —€œpersistent oil—€ (heavy oils which do not evaporate readily) from oil tankers; Protection of the Sea (Prevention of Pollution from Ships) Act 1983 to prohibit the disposal from a ship into the sea of incinerator ashes from plastic products which may contain toxic or heavy metal residues; allow garbage disposal placards to be written in Spanish (rather than English or French); and convert penalties from monetary amounts to penalty units. Trade Practices Act 1974 to clarify that stevedoring operators are not permitted to collude in setting charges for stevedoring services. Also repeals the Bass Strait Sea Passenger Service Agreement Act 1984.

Gives effect to Australia—€™s obligations under the Council of Europe Money-Laundering Convention and other international instruments concerning the confiscation of proceeds of crime by providing for a civil forfeiture scheme, which will operate in parallel with the existing conviction-based confiscation regime, to confiscate unlawfully acquired property without first requiring a conviction. Social Security and Veterans—€™ Entitlements Legislation Amendment (Disposal of Assets—€”Integrity of Means Testing) Bill 2002

Amends the Social Security Act 1991 and Veterans—€™ Entitlements Act 1986 in relation to gifting of assets by introducing a free area of $25 000, over and above already deprived assets, that will apply over a rolling 5-year period and will operate concurrently with the current $10 000 per year free area. Gifts in excess of this $25 000 free area within the 5 years will be assessed as a deprived asset for 5 years. Also changes the applicable period from a pension year to a financial year. The new rules will apply from 1 July 2002.

Superannuation Legislation Amendment (Family Law) Bill 2002

Amends 7 Acts in relation to Commonwealth civilian and Australian Defence Force superannuation schemes as a consequence of new legislative arrangements for splitting superannuation on marriage breakdown. The bill provides for a framework within each relevant superannuation scheme for dealing with an agreement made by separating parties or a Family Court order that provides for an amount of the member—€™s superannuation to be allocated and paid to the member—€™s former spouse.

Suppression of the Financing of Terrorism Bill 2002

Part of a package of four bills, the bill implements Australia—€™s obligations under United Nations Security Council Resolution 1373 and the International Convention for the Suppression of the Financing of Terrorism by amending the: Criminal Code Act 1995 to insert an offence directed at those who provide or collect funds to facilitate terrorist activities; Financial Transaction Reports Act 1988 and Mutual Assistance in Criminal Matters Act 1987 to: require cash dealers to report suspected terrorist-related transactions; and streamline procedures for the disclosure of financial transaction reports information to foreign countries; and Charter of the United Nations Act 1945 to introduce higher penalty offences for providing assets to, or dealing in assets of, persons and entities engaged in terrorist activities. Also provides for an independent review of the amendments made to the Financial Transaction Reports Act 1988 and Mutual Assistance in Criminal Matters Act 1987.

Amends the termination of employment provisions of the Workplace Relations Act 1996 by: excluding certain classes of employees, including short-term casual employees; validating the operation of regulations purporting to exclude short-term casual employees (following a Federal Court decision invalidating these regulations) from the time the regulations were made to the commencement of the new termination provisions in this bill; and providing for payment, and indexation, of a lodgment fee for termination of employment applications; and Workplace Relations Regulations 1996 to repeal now invalidated provisions excluding certain classes of employees from termination of employment provisions.
