Administrative Decisions (Effect of International Instruments) Bill 1999

Responds to the High Court decision in Minister for Immigration and Ethnic Affairs v Teoh by providing the necessary statutory indication to ensure that entry into a treaty by the Australian Government does not give rise to a legitimate expectation in administrative law that the Government will act in accordance with the treaty, which could form the basis for challenge.

S Agricultural and Veterinary Chemicals Legislation Amendment Bill 2001

As a consequence of the High Court—€™s decision in R v Hughes, the bill amends the Agricultural and Veterinary Chemicals Act 1994 to clarify the powers, functions and duties of Commonwealth officials and authorities within the National Registration Scheme for agricultural and veterinary chemicals, including the conferral of duties, functions and powers on the Administrative Appeals Tribunal and on inspectors and analysts.

Australian Securities and Investments Commission Bill 2001

Part of a package of bills introduced in response to the High Court—€™s decisions in Re Wakim; ex parte McNally and R v Hughes, the bill replaces the Australian Securities and Investments Commission Act 1989 and the ASIC Law of the Capital Territory, and corresponding provisions of Corporations Acts of the Northern Territory and certain States to provide for a Commonwealth Act capable of operating throughout Australia. Amends the: International Air Services Commission Act 1992 to streamline International Air Services Commission processes; Air Navigation Act 1920 (in anticipation of new aviation security regulations) to: introduce a framework for handling aviation security information (including application of the Criminal Code); reform the regulation of the carriage of munitions and implements of war on civil aircraft; and repeal aviation security provisions. Choice of Superannuation Funds (Consumer Protection) Bill 1999

Part of a package of three bills in relation to superannuation arrangements for Commonwealth employees, the bill amends the: Superannuation Amendment Act 1976, Superannuation Act 1990, Superannuation (Productivity Benefit) Act 1988, Superannuation Benefits (Supervisory Mechanisms) Act 1990, Parliamentary Contributory Superannuation Act 1948, Superannuation Legislation Amendment Act (No. 1) 1995, Administrative Appeals Tribunal Act 1975, Law Officers Act 1964 and Workplace Relations Act 1996 in relation to the closure of the public sector superannuation scheme (PSS) to new members from 1 July 1998. The bill allows existing and new Commonwealth employees to choose from alternative superannuation arrangements made available by their employers. As a consequence, the bill will amend the administrative arrangements for the Commonwealth—€™s closed superannuation schemes (PSS and Commonwealth Superannuation Scheme (CSS)). The bill also repeals the: Superannuation Act 1922, Superannuation Act 1976, Superannuation Act 1990, Superannuation (Productivity Benefit) Act 1988 and the superannuation and retirement income provisions of the Papua New Guinea (Staffing Assistance) Act 1973. However, certain aspects of the repealed legislation will continue to operate through the application of the proposed Superannuation Legislation (Commonwealth Employment—€”Saving and Transitional Provisions) Act 1997. The bill also amends the rules for the administration of the PSS in relation to superannuation redundancy benefits.
